Terms of Use and Privacy Policy

Please read these terms carefully. They are a legal agreement between you and The Healthstyle Doctor Ltd, trading as The Healthstyle Doctor. By using this website, joining The Morning Room, buying a course or handbook, booking coaching, or booking a consultation, you agree to them.

This document has five parts:

  • Part A applies to everyone and everything.
  • Part B applies if you join The Morning Room or the group coaching tier.
  • Part C applies if you book coaching.
  • Part D applies if you book a 1:1 medical consultation.
  • Part E is our Privacy Policy.

If a part of this document conflicts with another, the more specific part wins. Part D takes priority over everything else, because consultations are regulated medical care.

Part A: Terms that apply to everything

1. Who we are

This website and everything on it is operated by The Healthstyle Doctor Ltd, a company registered in New Zealand, trading as The Healthstyle Doctor. Where we say “we”, “us” or “our”, we mean The Healthstyle Doctor Ltd. Where we say “you”, we mean you, the person using the site or buying from us.

Dr Taisia Cech is a doctor registered with the Medical Council of New Zealand. That registration matters in Part D. It does not mean that reading this website, joining The Morning Room, or doing a course makes you her patient. See clause 3 below.

You can reach us at [email protected].

2. Your account

You must be 18 or over to buy from us or create an account.

When you register you will give us your name, your email address and, where relevant, payment details. You agree to give us accurate information and to keep it up to date.

You are responsible for keeping your password confidential and for everything that happens under your account. Accounts are personal to you. You may not share your login, and you may not give another person access to paid material you have bought. Tell us as soon as possible if you think someone else has access to your account.

3. What our content is, and what it is not

Everything on this website, in our emails, in our free resources, in our paid courses and handbooks, and inside The Morning Room is general health education. It is written for a general audience. It is not personalised medical advice and it is not a diagnosis or a treatment plan for you.

Reading our content, joining our membership, or attending a group call does not create a doctor-patient relationship between you and Dr Cech, and does not create any other professional or treatment relationship.

We do not know your history, your medications, your test results or your risk factors. Only a clinician who assesses you can give you advice about your own care.

You should always talk to your own doctor or another suitably qualified health professional before acting on anything you read or hear from us, before starting or stopping any medicine, supplement or treatment, and before making significant changes to how you eat, move or manage a health condition.

If you think you are having a medical emergency, call 111 or go to your nearest emergency department. Do not wait for a reply from us. We do not monitor email, social media, community posts or direct messages for urgent problems, and we cannot provide urgent or after-hours care.

4. No guarantee of results

We do not promise or guarantee any particular outcome from our content, courses or membership. That includes symptom relief, weight change, sleep, mood, energy, hormone levels or any other health measure. Results differ from person to person and depend on factors outside our control.

Nothing we publish should be read as a claim that a product, programme or approach will cure, treat or prevent any disease.

5. Movement, yoga and physical activity

Some of what we provide involves physical movement. That includes the yoga, breathing and meditation practices in The Morning Room, and any exercise or activity suggested in our courses, handbooks, live sessions or resources.

These are general classes and general guidance. They are not tailored to you, nobody is watching you practise, and we cannot see whether a movement is safe for your body on any given day.

Before you start any movement practice or exercise from us, please check with your doctor or another suitably qualified health professional if any of the following apply to you:

  • you are pregnant, have recently given birth, or are trying to conceive
  • you have any injury, or any joint, back, neck, bone or muscle problem
  • you have a heart condition, high or low blood pressure, or you get dizzy, faint or breathless
  • you have osteoporosis, low bone density, or a history of fractures
  • you have any condition that is affected by exercise, or any condition you are unsure about
  • you are recovering from surgery, illness or a medical procedure
  • you are taking medication that affects your blood pressure, balance or heart rate

If you are not sure whether a practice is safe for you, ask your own health professional before you begin. Do not use our videos to decide that for yourself.

While you practise, work at your own pace and within your own limits. Come out of anything that causes pain, dizziness, breathlessness or discomfort, and stop straight away if you feel unwell. Never push into pain. Use props, modify, rest, or skip anything that does not suit your body that day. Make sure you have clear space around you and stable footing.

You take part in any movement, yoga, breathing or exercise activity entirely at your own risk. To the fullest extent the law allows, we accept no responsibility or liability for any injury, strain, aggravation of an existing condition, or any other loss or damage arising from your participation. Clause 13 also applies.

6. Things you must not do

When using our website, our community or any of our products, you must not:

  • break any law, or encourage anyone else to
  • post advertising, spam, chain messages, or promote your own or someone else’s business, products or services without our written permission
  • post anything that is abusive, harassing, threatening, defamatory, obscene, hateful, or that targets a person or group
  • give individual medical advice to other members, or hold yourself out as a health professional when you are not
  • share, sell, copy, screenshot for distribution, or republish any of our paid material, including recordings, handbooks, worksheets and course videos
  • share another member’s personal or health information outside the community
  • upload malicious code, or attempt to gain unauthorised access to our systems, other accounts, or any part of the site you are not meant to reach
  • scrape, data mine or use automated tools to extract our content
  • use our content to train an artificial intelligence model or system

We may remove content and suspend or terminate access, without refund, if you breach this clause.

7. Your content and the conduct of others

If you post anything in our community, on a call, or anywhere else on our platform, you remain responsible for it. You confirm you have the right to post it and that it does not infringe anyone else’s rights.

By posting, you give us a non-exclusive, royalty free, worldwide licence to host, store, display and share that content for the purpose of running our services. If we want to use something you have written as a testimonial or in our marketing, we will ask you first.

We may moderate, edit or remove content, and we may remove members, but we are not obliged to monitor everything. We do not vet or background check other members, and we are not responsible for what they say or do. Anything another member tells you is their view, not ours, and is not medical advice.

8. Our intellectual property

All material we produce, including text, video, audio, images, handbooks, worksheets, course structure, branding and the site itself, belongs to us or our licensors and is protected by copyright and other laws.

When you buy a course, handbook or membership, you are buying a personal, non-transferable, non-exclusive licence to access and use that material for your own personal use, for as long as your access lasts. You may download or print material where we have made it available for that purpose.

You may not copy, reproduce, distribute, sell, publish, adapt or share our material, in whole or in part, without our written permission. This includes sharing inside private groups, sending files to friends, and uploading material anywhere else.

9. Availability, changes and technical quality

We may add, change, update or remove content at any time, without notice. We may change the platforms and tools we use to deliver our services.

We aim to keep things running, but we do not guarantee that the site, the community or any live call will always be available, uninterrupted or error free. Live and streamed content depends on your internet connection and your device, and we cannot guarantee video or audio quality.

If a scheduled live call has to be cancelled or moved, we will tell you as soon as we reasonably can and will normally make a recording or a replacement session available.

10. Links and third party services

Our site and content may link to third party websites, products or services, including practitioners, laboratories, supplement suppliers and other educators. We provide those links for information only. We do not control those third parties and we are not responsible for their content, their products, their advice or their privacy practices.

Some links may be affiliate links, which means we may receive a fee or commission if you buy through them. Where that is the case we will say so. An affiliate relationship never changes what we recommend clinically or educationally.

11. Unsolicited ideas

If you send us an idea, a suggestion or feedback that we did not ask for, you agree we may use it without any obligation to you and without payment. Please do not send us confidential information you do not want us to use.

12. Copyright complaints

If you believe something on our site infringes your copyright or trade mark, email [email protected] with a description of the work, where it appears on our site, your contact details, and a statement that you believe the use is unauthorised. We will investigate and remove infringing material where appropriate.

13. Limitation of liability

Please read this clause carefully.

Our website, content and services are provided on an “as is” and “as available” basis. To the fullest extent the law allows, we exclude all warranties, conditions and representations that are not expressly set out in these terms.

To the fullest extent the law allows, we are not liable for any indirect, consequential, special or incidental loss, or for loss of profit, loss of income, loss of data or loss of opportunity, however caused.

Where we are found liable, our total liability to you for all claims connected with our services is limited to the greater of NZD $200 or the total amount you have paid us in the 12 months before the claim arose.

Nothing in these terms limits our liability for fraud, for death or personal injury caused by our negligence, for any liability that cannot be limited under New Zealand law, or for any of our obligations under Part D.

Your consumer rights. If you are a consumer in New Zealand, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that cannot be excluded, restricted or modified, and nothing in these terms attempts to do so. Where the Consumer Guarantees Act applies, these terms operate alongside it, and your rights under that Act sit on top of anything written here.

14. Indemnity

You agree to indemnify us against any claim, loss, cost or expense that arises from your breach of these terms, your misuse of our services, anything you post, or your infringement of someone else’s rights. This does not apply to loss caused by our own breach or negligence.

15. Suspension and termination

You can stop using our services at any time. Cancellation of a paid subscription is dealt with in Part B.

We may suspend or end your access if you breach these terms, if your payment fails, or if we reasonably believe your conduct is putting other members or our team at risk. Where we end your access because of your breach, we are not required to refund you.

If we end your access for a reason that is not your breach, for example because we discontinue a product, we will refund you a fair proportion of any fees you have paid for access you have not yet received.

16. Notices

We will send notices to the email address on your account. It is your responsibility to keep that address current. You can send notices to us at [email protected].

17. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If we make a change that materially affects your rights, and you hold a current subscription or booking, we will tell you by email before it takes effect. Continuing to use our services after that means you accept the updated terms.

18. Assignment

You may not transfer your rights under these terms to anyone else. We may transfer ours to a related entity or to a buyer of our business, and we will tell you if we do.

19. Governing law and disputes

These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.

Our website can be reached from anywhere, but our services are designed for a New Zealand audience and we make no claim that our content is appropriate or lawful in other countries. If you access our services from outside New Zealand, you do so on your own initiative and you are responsible for complying with your own local laws.

If you have a problem, please tell us first. Email [email protected] and we will try to resolve it directly. Most things can be sorted this way. If you are unhappy with the care you received in a consultation, see Part D for the complaints process, which is different and is your right.

Part B: The Morning Room and group coaching

20. What The Morning Room is

The Morning Room is a paid monthly membership offering perimenopause education, resources, live group sessions, a yoga and meditation library, and a member community.

It is education and support delivered to a group. It is not medical care, it is not a consultation, and joining does not make you Dr Cech’s patient. Clause 3 applies in full. Nothing said in a group session or in the community is personalised medical advice to you, even if it is said in response to your question.

The yoga, breathing and meditation practices are general classes. Clause 5 applies to all of them, and you should read it before you practise.

Dr Cech cannot prescribe for you, order tests for you, review your results, write referrals or provide clinical documentation through the membership. Those things require a consultation under Part D.

21. Fees and billing

Membership fees are stated in New Zealand dollars and are charged monthly in advance. The price shown at the time you join is the price you pay.

Your subscription renews automatically each month until you cancel. By joining you authorise us to charge your payment method on each renewal date.

Founding member pricing. If you join during a founding member period at a stated founding rate, that rate is held for as long as your membership runs without interruption. If you cancel and later rejoin, you rejoin at the price current at that time.

Price changes. We may change the price of the membership for future billing periods. We will give you at least 30 days’ notice by email before a price change affects you, and you may cancel before it takes effect.

Failed payments. If a payment fails we will attempt to charge again and will let you know. If payment is not resolved, your access may be paused or ended.

22. Cancelling

You can cancel at any time, from your account settings or by emailing [email protected].

Cancellation takes effect at the end of the month you have already paid for. You keep full access until then. We do not charge a cancellation fee and there is no minimum term.

Once your membership ends you lose access to the member area, the community, live sessions and all member resources, including material you have not yet worked through. Anything you have downloaded is yours to keep, under the licence in clause 8.

23. Our 30 day guarantee

We offer a 30 day money-back guarantee on your first payment.

If you join and decide within 30 days that it is not right for you, email [email protected] and tell us. We will refund your first payment in full and close your membership. You do not have to justify your decision.

The guarantee applies to your first payment only, and only the first time you join. It does not apply to later monthly payments, and it does not apply if you cancel and rejoin. After the first 30 days, membership fees already paid are not refunded, except where you have rights under the Consumer Guarantees Act 1993, which are not affected by this clause.

24. The group coaching tier

We may offer a higher tier that adds small group coaching to your membership.

The group coaching tier runs on the same terms as the membership: monthly in advance, cancel anytime with access to the end of the paid month, and the same 30 day money-back guarantee on your first payment at that tier.

Group coaching is coaching, not medical care. Part C applies to it, including the escalation clause in clause 28.

You can move between tiers. If you upgrade, the new rate applies from your next billing date. If you downgrade, you keep the higher tier until the end of the period you have paid for, then move down.

25. Live sessions, recordings and privacy in the group

Live sessions are usually recorded and made available to members. If you do not want to appear in a recording, keep your camera off and use the chat rather than speaking. Tell us beforehand if you have any concern about being recorded.

Recordings are for members only, for the duration of their membership. You may not download, share, republish or distribute them.

Confidentiality between members. What other members share in sessions and in the community stays there. You must not repeat, screenshot, forward or publish another member’s personal or health information outside the group. This is a condition of membership and we take it seriously.

We cannot guarantee that every member will keep this promise. Please share only what you are comfortable sharing in a group setting.

26. Ending or changing the membership

We may change what is included in the membership, including the schedule and format of live sessions, so long as the overall value of what you receive is not materially reduced.

If we decide to close the membership altogether, we will give you at least 30 days’ notice, we will not charge you again after that notice, and we will refund any period you have paid for that you will not receive.

Part C: Coaching

27. What coaching is

Coaching is non-clinical. It is structured support to help you set goals, build habits, work through practical obstacles and apply general health education to your own life. It may be delivered one to one or in a small group.

Coaching is not medical care. During coaching, Dr Cech is acting as a coach and not as your doctor, even though she is a registered doctor. Coaching does not create a doctor-patient relationship, and no clinical record is created.

In coaching we will not diagnose you, will not give you individualised medical advice, will not prescribe or adjust any medicine, will not order or interpret your test results, and will not provide referrals, medical certificates or clinical letters.

28. If a clinical question comes up

This is important, so we have written it down.

If, during coaching, a question arises that needs clinical judgement about you personally, we will stop and say so. We will not answer it inside the coaching session.

At that point you have two options. You can take the question to your own GP or specialist, which is often the right answer. Or you can book a consultation with us under Part D, which is a different service on different terms, with proper history taking, consent, records and follow-up.

We will never continue as though a coaching session can do the job of a consultation. This protects you.

29. Who coaching is not suitable for

Coaching is not appropriate if you are in crisis, if you are acutely unwell, if you are having thoughts of harming yourself, or if you need urgent care. If any of that applies, contact your GP, call or text 1737 free to speak with a trained counsellor, or call 111 in an emergency.

Coaching may also not be appropriate if you have a current or past eating disorder or a history of disordered eating, or if you have a serious untreated medical or mental health condition. Please talk to your treating clinician before starting, and tell us if this applies to you so we can work safely or refer you on.

We may decline to start or continue coaching if we believe it is not the right or safe service for you. If we do, we will tell you why and refund any sessions you have paid for and not used.

30. Your responsibility

You remain responsible for your own health decisions and for the actions you take. Coaching is support, not instruction, and you can stop at any time.

You agree to keep your own doctor informed about anything that affects your care, and to tell us if your health changes in a way that affects our work together.

31. Confidentiality in coaching

What you tell us in coaching is kept confidential and is not shared with anyone else, except where we are required by law to disclose it, or where we reasonably believe there is a serious risk of harm to you or to someone else.

Coaching notes are working notes, not clinical records. They are not part of a health record and are not sent to your GP.

32. Coaching fees and cancellations

Fees are stated at the time of booking, in New Zealand dollars.

Group coaching inside the membership is billed as part of the membership, under clause 24.

For paid 1:1 coaching sessions, payment is due before the session. If you need to move or cancel a session, please give us at least 48 hours’ notice and we will reschedule at no cost. With less than 48 hours’ notice, or if you do not attend, the session fee is payable. We will always use judgement where something genuinely unavoidable has happened.

We do not guarantee any particular outcome from coaching. Clause 4 applies.

Part D: 1:1 medical consultations

33. This part is different

A consultation is medical care. When you book a consultation, Dr Cech is acting as your doctor, a doctor-patient relationship is created, a clinical record is kept, and all the obligations of a registered medical practitioner in New Zealand apply.

Nothing anywhere else in this document reduces those obligations, and where any other part of this document conflicts with this Part, this Part wins.

Your rights as a health consumer are set out in the Code of Health and Disability Services Consumers’ Rights. You can read it at hdc.org.nz.

Full consultation terms, including consent, are set out on our Consultation Terms and Consent page.

34. What a consultation involves and what it does not

Consultations are lifestyle and perimenopause focused. They complement the care you get from your usual GP or specialist. They do not replace it, and we are not your after-hours or urgent care provider.

We will take a detailed history, discuss your concerns, and work with you on a plan. A full verbal explanation of your plan is given at the time of consultation, and a written summary is emailed to you within 72 hours.

You have the right to seek a second opinion at any time, and the right to withdraw from our services at any stage.

Please tell us before or during your consultation if you are pregnant, trying to become pregnant, or become pregnant during our work together, if you have any allergies, if you have any medical or mental health condition that affects your assessment or treatment, if your condition changes, if you have any concerns about your plan, or if you have cultural needs we should know about.

35. Consent

Booking and attending a consultation means you consent to assessment and treatment on the basis set out here. A separate consent form is provided before your first appointment and forms part of these terms.

You are entitled to have a support person with you, unless doing so would compromise safety or unreasonably affect someone else’s rights. You are also entitled to free, independent advocacy through the Health and Disability Advocacy Service on 0800 11 22 33.

36. Fees

Consultation fees are advised to you at the time of booking and are confirmed in your booking confirmation. Current fees are also available on request. All fees are in New Zealand dollars.

Payment for an initial consultation is due before the appointment. Follow-up consultations are invoiced, with payment due within two weeks.

We may change our fees from time to time. Any change applies to appointments booked after the change, never to an appointment you have already booked.

37. Cancellations and non-attendance

Please give at least 48 hours’ notice if you need to move or cancel an appointment. With 48 hours’ notice or more, there is no charge, and you can reschedule yourself using the button at the bottom of your confirmation email.

If you cancel with less than 48 hours’ notice, a fee of 50% of the appointment cost is charged and invoiced to you.

If you do not attend your appointment without cancelling, the full appointment fee is charged and invoiced to you.

If an account remains unpaid and is referred for debt recovery, you are responsible for the recovery costs and a $50 administration fee.

38. Your health information

All information recorded in your health record is kept confidential in accordance with the Privacy Act 2020 and the Health Information Privacy Code 2020. It is accessed only by people who need it to provide your care.

We use Acuity Scheduling to take and manage your appointment bookings. Information you give when booking, such as your name, contact details and the reason for your appointment, is held there.

We use Elixir, a practice management system, to store your clinical notes, to order blood tests and to send referrals. Where we order a test or make a referral, the information necessary for that test or referral is shared with the laboratory or with the provider we are referring you to.

We use Heidi, an AI-assisted medical dictation and note-taking service, to help produce consultation notes. Information provided to Heidi includes identifying details such as your name, along with the clinical content of your consultation. Heidi processes and stores this information on our behalf under its own security and privacy obligations. You may ask us not to use this service for your consultation, and we will take notes without it. Your consent to its use is discussed with you and recorded before your first appointment.

We use Stripe to take payment and to issue your invoices and receipts.

Unless you tell us otherwise, we take it that you give us permission to write to your referring GP or specialist, or to share relevant information with your usual GP if you referred yourself. Continuity of care is safer for you.

We will not give your information to any other third party without your permission, unless we are required to by law, or unless we reasonably believe there is a serious risk to your safety or someone else’s.

You have the right to access your health information and to ask for it to be corrected. If information is used for audit purposes, it is de-identified so you cannot be personally identified.

We keep your health record for at least 10 years from the day after we last provided services to you, as required by the Health (Retention of Health Information) Regulations 1996.

39. Complaints

If you are unhappy with any aspect of your care, please tell us. Email [email protected] and we will respond.

You also have the right to complain to the Health and Disability Commissioner at any time, and you do not have to come to us first. You can find out how at hdc.org.nz. You can also get free support from the Health and Disability Advocacy Service on 0800 11 22 33.

Part E: Privacy Policy

40. Who this covers

This policy explains how we collect, use, store and share personal information. It is written to meet the Privacy Act 2020. Health information collected in a consultation is also covered by the Health Information Privacy Code 2020, and clause 38 applies to it in addition to this Part.

41. What we collect

Depending on how you interact with us, we may collect:

  • your name, email address and, sometimes, your phone number
  • your payment details, which are collected and held by our payment provider, not by us
  • what you have bought, and your subscription and billing history
  • what you do on our site and in our emails, including pages visited, emails opened and links clicked
  • anything you post in the community or send us by email or direct message
  • answers you give in quizzes, forms, surveys and waitlists
  • technical information such as your IP address, browser and device type

For consultation patients, we also collect the health information you give us and the clinical records we create. That is held separately from our marketing systems.

42. How we use it

We use your information to give you what you bought, run your membership and process payments, send you the emails you signed up for, answer you when you contact us, improve our content and understand what is useful, meet our legal and professional obligations, and keep our systems secure.

Every marketing email has an unsubscribe link, and unsubscribing takes effect for all marketing. It does not stop essential emails about something you have bought, such as receipts or membership notices.

We do not sell your personal information. Ever.

43. Who we share it with

We use third party services to run the business, and those providers process some of your information on our behalf. They are only permitted to use it to provide their service to us.

  • Kajabi, which hosts our website, courses, membership, community and email
  • Stripe, which processes payments and issues invoices and receipts. We do not see or store your full card number.
  • ManyChat, which handles automated Instagram and Facebook messaging where you have started a conversation with us
  • Acuity Scheduling, which manages consultation and appointment bookings
  • Elixir, our practice management system, used for clinical notes, ordering blood tests and sending referrals
  • Heidi, used for AI-assisted medical dictation in consultations, as described in clause 38
  • Xero, for accounting
  • Google Workspace, for email and document storage

Some of these providers are based outside New Zealand and your information may be stored or processed overseas. We take reasonable steps to ensure they have comparable privacy safeguards.

We may also disclose information where the law requires it, where it is needed to prevent a serious threat to someone’s health or safety, or where you have given us permission.

44. Cookies and tracking

Our site uses cookies and similar technologies to make it work, to remember you between visits, and to understand how the site is used. You can control cookies in your browser settings, but some parts of the site may not work properly if you disable them.

We may use analytics and advertising tools to measure how our content and ads perform. Where consent is required, we ask for it.

45. How long we keep it

We keep your information only as long as we need it.

  • Marketing contacts: while you are subscribed, and for a reasonable period after, unless you ask us to delete you sooner
  • Customer and membership records: for as long as needed to run your account, and afterwards for the seven year period required for tax and business records
  • Clinical records: at least 10 years, as set out in clause 38

46. Your rights

You have the right to ask what personal information we hold about you, to get a copy of it, and to ask us to correct anything that is wrong. Email [email protected] and we will respond within 20 working days.

You can unsubscribe from marketing at any time, and you can ask us to delete your information, though we may need to keep some of it where the law requires.

If you are not happy with how we have handled your information, you can complain to the Office of the Privacy Commissioner at privacy.org.nz.

47. Security

We take reasonable steps to protect your information, including using reputable providers, restricting access, and keeping clinical records separate from marketing systems. No online system is completely secure, and we cannot guarantee absolute security.

48. Children

Our services are for adults. We do not knowingly collect information from anyone under 18. If you believe we have, tell us and we will delete it.
